Hello.
I have been a victim of aspirate gmbh.
They sent me the "Rechnung" for a service that I have not intended to buy or use
After some time, they sent me some messages like: Pay or You will get problems with German Police.
I have decide to pay a few months later (First occurrence was im Dezember 2008);
Last March, I have paid to de Proinkasso company.
surprise: The still claim for the money! And they keep up mencing with Police and so on
I tried to speak with the Bayern Police, Verbraucher Zentrale and German Botshatft im Portugal (Where I live).
We are speaking about 170€.
And for such amount, everybody says: forget! It is not enough to hirer a good lawyer!
I am very disappointed with this especially with German authorities: they do not care!

Hallo.
Ich bin ein Opfer des Hauchlauts gmbh gewesen.
Sie sandten mir den "Rechnung" für einen Dienst, den ich nicht vorgehabt habe, zu kaufen oder zu verwenden
Nach einer Zeit sandten sie mir einige Nachrichten wie: Bezahlung oder Sie werden Probleme mit der deutschen Polizei bekommen.
Ich habe entscheiden sich dafür, ein paar Monate später zu zahlen (das Erste Ereignis war im Dezember 2008);
Im letzten März habe ich zur Gesellschaft von de Proinkasso gezahlt.
Überraschung: Noch fordern für das Geld! Und sie erhalten mencing mit der Polizei und so weiter aufrecht
Ich versuchte, mit der Bayern Polizei, Verbraucher Zentrale und deutschem Botshatft im Portugal zu sprechen (Wo ich lebe).
Wir sprechen ungefähr 170 €.
Und für solchen Betrag sagt jeder: Vergessen Sie! Es ist nicht genug dem Mieter ein guter Rechtsanwalt!
Ich bin damit besonders mit deutschen Behörden sehr enttäuscht: Sie sorgen sich nicht!

Do NOT pay any money to this company!

You won't need a lawyer: They would have to prove the existence of a legal contract, but there is not any legal contract (keywords: "überraschende Klauseln" and "Preisauszeichnungsverordnung"). So they write you scary letters to trick you into paying money.

Dear Viera,

I agree with what Borlander said. In general, contracts of that kind are simply void, either because it was not entirely clear to the customer that he would end up paying for something (very popular: small dark grey writing on light grey ground), or because the company missed out on advising you about the possibility to cancel the contract within 14 days.

As this sort of behaviour is not in accordance with applicable law, designed to protect end users from dishonest business conduct, you do not have to pay anything.

The only situation in which it is strongly recommendable to react is when you receive a court order. Then it would be necessary for you to protest against it. However, this is rather unlikely to happen, with the lawyers being aware of the fact that the odds for winning the trial are quite poor for them.

To put it in a very simple way: it's best for you to sit back and relax!
